Lawsuit of the Main-Kinzig-Kreis: Hessen ignores calls for help to distribute refugees!

On April 25, 2025, the Hesse Administrative Court rejected the Standard Control Lies of the Main-Kinzig district against the state of Hesse. This lawsuit had been rejected for formal reasons, since the district's application was not submitted within the legally required period. The Main-Kinzig district, which counts around 430,000 inhabitants, saw itself disadvantaged in the assignment of refugees, compared to the independent city of Frankfurt with around 770,000 inhabitants. The corresponding legal ordinance on the distribution of refugees was issued in 2009 and stipulates that standards control lawsuits must be submitted within one year. The Main-Kinzig-Kreis made its application almost two years ago.

The district administrator Thorsten Stolz (SPD) expressed that the Main-Kinzig-Kreis feels unfairly treated. The background to the lawsuit was the perception that the assignment of federal funds is linked to the number of inhabitants, but the distribution of refugees is not fair. "The main criticism is that we are classified in the same size class with Frankfurt, while the financial means are actually not made available to us in the same way," said proudly during a press conference in Gelnhausen, where he explained the background of the standards control lawsuit.

The application comprised 30 pages and was particularly directed against mistakes in the "Distribution and Accommodation Fee Ordinance" of the State of Hesse. While the Main-Kinzig-Kreis took around 10,500 people during the Ukraine secretary, the number of refugees recorded was only 6,500 in 2015/16. This massive increase in refugee numbers has heavily burdened the large areas of the area, although the refinancing takes place according to the number of population.

In this context, the social secretary Susanne Simmler criticized the violation of the basic principles of equal treatment and proportionality. The Main-Kinzig-Kreis has a recording rate of 8.5%, while a circle with 100,000 inhabitants only absorbs 1%. This clearly shows how disproportionate the distribution is in practice.

The state government's legal representative announced that discussions have been announced on a "proper and politically appropriate solution" for the summer of 2025. It remains to be seen how the state of Hesse will react to the call for help in the Main-Kinzig district. The lawyer Dr. Olaf Otting represents the district in the legal dispute and has already requested that the state of Hesse have to comment. News from the state government could follow in the coming weeks.

The Darmstadt regional council, which is responsible for the internal distribution and assignment of refugees in Hesse, assumes the responsibility for the implementation of the specified odds on the counties and independent cities. This is done in accordance with the regulations of the Asylum Act, which also regulate the distribution of foreigners with the stay through humanitarian measures. Despite this political framework, the distribution must be designed in such a way that it takes into account the real conditions and the pressure on the respective municipalities.
