Racist smearings in Neuwied: Protest against refugee village!

Racist smearings on metal containers of a construction company were discovered in Neuwied. The smearings were found shortly before Christmas and are part of a current incident that occurs in connection with the construction of a container village. This container village is intended for 264 refugees who are to be accommodated in the first quarter of 2025. The construction company reacted to the discovery and removed the smearings on the same day when she learned about it. Since December 22, several advertisements have been issued in this context, such as Rhein-zeitung.de reported.

Legal framework on racist statements

The legal aspects of racist statements are complex and are treated in various procedures of the judiciary. The Higher Regional Court of Frankfurt am Main decided on November 30, 2022 in procedures 3 SS 131/22 and 3 SS 123/22 that the fact of incitement is tight with regard to the fundamentally protected freedom of expression. In these procedures, revisions against releases for sedition were examined.

In one of the cases, it was about a North Hessian local politician who published a post on Facebook in 2019 with an image text collage of men black skin color. The court found that several interpretations of the post are possible, which meant that no criminal liability according to § 130 StGB a. F. was accepted. In the second case, the district court had to clarify whether the insults of an Islamist preacher were sufficiently delimited. The objective meaning of a statement is crucial, and in the case of several seriously considering interpretations, the interpretation must be carried out in favor of the defendant, such as Jura.cc explained.
