On April 2, 2025, a 30-year-old was acquitted by the Frankfurt district court. The man had been accused of raping a young person with a reduction in intelligence several times. During the proceedings, the presiding judge made it clear that the accused's guilt could not be cleared out of this crime, and there were "unavailable doubts" of his perpetrator. These impressions significantly shaped the six -day criminal trial. During the negotiation, the accused admitted that he had sexual intercourse with the then 16-year-old young person in 2022, assuming that she was older. He argued that she hadn't resisted.
The allegations arose from an incident in which the 15-year-old classmate of the young woman was identified as a perpetrator. This classmate had made the young people to practice sexual intercourse with the 30-year-old against money. The classmate kept the money paid for sexual intercourse. The judge described her behavior as "blatant abuse" and recalled that the youth court in Offenbach had already been convicted of forced prostitution last year. Her punishment included 80 hours of work and participation in a social training course.

The 15-year-old had told the young person that she could earn money through sexual intercourse with the man. This happened without the young people being perceived as a victim. Only after the youngsters had told her teacher about the incident - which she had previously classified as a "friendship service" - was she prompted by the reactions of her environment to present the action as an abuse. In the verdict, the judge found that the girl had "found it nothing bad". This dynamic was of crucial importance for the outcome of the procedure.
The public prosecutor had asked for four and a half years in prison for the accused, while the man's lawyers applied for an acquittal. However, the judgment, which resulted in the accused's acquittal, is not yet final.
