Police operation in Kassel: Escape ends with injuries and drug discovery

On January 22, 2025, an unusual incident occurred in Kassel when a 27-year-old man from Bad Arolsen tried to avoid police control. The incident began around 4 p.m. when the officials observed suspicious activities on the star and wanted to stop the man. In the attempt to flee, he first collided with a pedestrian who was slightly injured by the arm. Just a few meters further, he collided with a 57-year-old e-scooter driver, who also suffered mild injuries.

But the man's escape had fatal consequences for him. During his attempt to escape, he suffered a serious open shin, but, despite the injury, continued his flight for a short time until he was finally stopped by the police. During the subsequent check, the officers discovered around 12 grams of hashish with him. The 27-year-old immediately received first aid and was taken to a Kassel hospital with an ambulance to have the injuries treated.

Two days earlier, on Monday evening, there was another police operation in Kassel Central Station. Here there was a dispute between a 38-year-old man without a permanent residence and a 24-year-old Kasseler. The aggressor had rushed his mixer dog on the younger man, but the dog only barked. The dispute escalated quickly. The 38-year-old hit the Kasseler on the head, whereupon this and his 23-year-old companion informed the police.

The forces of the federal police and the Mitte police station quickly arrived. The 38-year-old was aggressive and resisted when the officials had to overwhelm and captivate him. As a result of his actions, criminal proceedings for assault were initiated against him. Such incidents are not uncommon and throw a light on the challenges with which the police are confronted every day.

Legal framework of the police flight

In the context of this escape, it is interesting to look at how the law reacts to such situations. According to Section 315d of the Criminal Code, police flight is considered a serious offense, which can be punished with a prison sentence of up to two years or a fine. This was confirmed by the Federal Constitutional Court in a decision of February 9, 2022. The legal consequences can also include the withdrawal of the driver's license and the confiscation of the vehicle.

The Federal Court of Justice of January 31, 2012 on claims for damages makes it clear that the persecution by the police can be provoked by the behavior of the fleeing. An example is a case in which a driver damaged several police vehicles during his escape because he did not take sufficient account of the risks of his actions. In such situations it becomes clear that flight not only has criminal consequences, but can also result in claims for damage under civil law. A road user must always recognize that he has to expect the consequences of his actions - this applies particularly to the police in critical situations.
