Rahden Hospital: Higher Regional Court continues to stop - what now?

On May 8, 2025, the Higher Regional Court of Hamm decided that the application of the city of Rahden will be rejected for the continued operation of the local hospital. This was done as part of an interim legal protection procedure. The district of Minden-Lübbecke and the mill circle clinics can now build on positive legal certainty that enables them to implement their plans for a modern health infrastructure. The decision is made by file number I-22 W 8/25 and 8 O 338/24.

The city of Rahden referred to a contract from 1955, which transferred the hospital building and the property to the then district of Lübbecke. The city argued that this 70 -year -old contract can be derived from a continued operator obligation. However, this argument was rejected by the Bielefeld Regional Court and the Higher Regional Court of Hamm, which underlines the decision of the courts.

In parallel to these judicial decisions, the Minden-Lübbecke district council decided with a large majority, and only six votes against the AfD and CDU, the closure of both the hospital in Rahden and the hospital in Lübbecke. The location in Espelkamp was chosen to ensure a maximum travel time of 20 minutes for patients from the surrounding places. These measures are part of a comprehensive plan to improve health care in Lübbecker Land.
