The Trump administration had asked the Supreme Court to enforce the ban during ongoing legal challenges. The Solicitor General D. John Sauer argued that without the order of the Supreme Court, the ban could not come into force for many months, which endanger military operational readiness. A Federal Appeal Court had previously followed a judicial order that blocked the ban nationwide. Nevertheless, Sauer calls for a nationwide enforcement of the ban, with the exception of seven complaining people and a prospective member of the armed forces.

The background

The WHO has no longer classified trans- and gender-various identities as a mental illness since 2019, and Trump's argument that the sexual identity of the persons concerned harms the operational readiness. The U.S. District Courge Judge Benjamin Settle had considered the ban to be insulting and discriminatory. He pointed out that the Trump administration did not provide a convincing reason why transgender troops that have been able to work openly in recent years should suddenly be excluded.

Reyes, temporarily stopped the implementation of the decree by listing the constitutional requirement of equal treatment before the law.
