The planned further construction of the Autobahn 445, which is an important transport connection between Hamm and Werl, stalls again. Due to extended complaints, the construction continues to be delayed, as Wa.de. The plaintiffs have expanded their applications by a plan supplementary decision, which was confirmed by the Arnsberg district government. This development represents a new hurdle for the already stressed project.
The plaintiffs, including a nature conservation association and a private individual, had already suspended their lawsuit in November 2021 to give Autobahn GmbH the opportunity to remedy defects. These defects concerned in particular questions of water law and the protection of bats. However, the Federal Administrative Court resumed the complaints at the end of January at the end of the gap, which reinforces the uncertainty around the schedule for the construction project.
Law deadline and planning approval decision
The plaintiffs have time to justify their applications by mid -April 2025. After that, the district government has a period of ten weeks. So far, no further legal objections to the project have been received. The planning approval decision for the gap closure was finally completed after years of improvements, and the details for this are to be published in early 2025. The binding disclosure of the supplementary decision took place from January 8th to 22nd, 2025, followed by a four -week deadline that may now be relevant.
As part of the project, rainwater retention basins are to be replaced by combined rainwater retention basins with retention floor filters in order to make the claims on the water and environmental protection more fair. In addition, additional risk management is carried out for bat protection. A total of two objections from the private side and 16 statements were submitted to public sponsors, which underlines the complexity of the procedure.
