Rescue service in danger: Björn Steiger Foundation complains before the constitutional court!

The Björn Steiger Foundation from Winnenden is planning to submit a constitutional complaint against the new emergency services law of Baden-Württemberg to the Federal Constitutional Court in Karlsruhe on March 13, 2025. This is a necessary step to address the current grievances in emergency care in Germany. According to the foundation, the federal government does not sufficiently meet its obligation to maintain a comprehensive and high-quality rescue service system.

President Pierre-Enric Steiger expresses that it is not only lacking in the responsibility of the federal government, but also not meet the regulations of the country to international standards. The foundation raises concrete criticism of legislation and sees it a direct violation of the Basic Law, which could hinder a nationwide improvement in emergency care. The submitted documents should be carried out electronically, and the foundation commissioned three well -known law firms.

criticism of the new emergency services law

The new emergency services law, which came into force on August 2, 2024, is intended to ensure that rescue workers will be at the scene within 12 minutes in 95% of the cases. However, this represents a decrease in the previous guidelines, which set an average arrival time of 10 to 15 minutes on average. President Steiger strongly doubts that the 12-minute period can be observed at all, especially since the foundation does not yet perceive significant improvements. The impression is that the new law has a cementing than a solving effect on the existing problems.

The foundation expresses particularly serious concerns about the so -called "death quota" of 20 percent for heart attack patients, which is legally anchored by the law. According to the critics, only 80 percent of the patients would have to be cared for within an hour, which could drastically reduce the chances of survival. They also find that outdated organizational structures and unclear responsibilities in an emergency reduce the probability of survival of life -threatening people.

The Björn Steiger Foundation is based in Winnenden and has been committed to improving the emergency services since 1969, the year after the death of Björn Steiger. Their founding persons, Ute and Siegfried Steiger, died in 2022. In the past few decades, the foundation was significantly involved in the introduction of nationwide emergency numbers 110 and 112.

Future of emergency care

A central concern of the foundation is the creation of nationwide uniform standards in the rescue system. In the past, this was sought by the previous coalition of the SPD, the Greens and the FDP, but abandoned according to that from the traffic light coalition. The foundation emphasizes the urgency that the federal government takes its responsibility again and immediately take measures to improve emergency care across the board.

The supporters of the complaint include the AGSWN, the DBRD, the notary network Honmed eG and the IG private ambulance service Baden-Württemberg. This illustrates how important the concern is for the entire industry. The report from Prof. Dr. Dr. Udo di Fabio also emphasizes that the state is mandatory to provide a functioning rescue service system, which is currently being strongly questioned.

It remains to be seen how quickly the Federal Constitutional Court will decide on this important matter, since the lawsuit could claim a decision for at least one year. The Björn Steiger Foundation continues to see its purpose and wants to stand up for the well -being of the emergency patients.
