Legal dispute over Bad Dürkheimer Brunnenhalle goes into the next round!

On January 5, 2025, the city administration of Bad Dürkheim reports that the work on the tenders for the conversion of the Brunnenhalle will progress. However, the legal dispute over the building permit, which was granted in April 2022, continues. In this context, the Koblenz Higher Administrative Court has already set an appointment for the appeal hearing. These renovation work is part of a long-standing plan of the city to convert the fountain hall into a modern cultural and congress center.

The building permit for the renovation and expansion of the fountain hall, which has been serving as an event building since the 1930s, has been contested by a resident in the past. This complained that the property on which its residential building is located borders on the fountain hall. According to a judgment of the 5th Chamber of the Neustadt Administrative Court, delivered on August 1, 2023, the lawsuit was dismissed. Details on the lawsuit and approval

The applicant made her lawsuit in September 2022 according to an unsuccessful objection procedure and claimed that her own rights were violated by the building permit granted. In particular, she accused the approval of being a "tailor -made building permit" for an inappropriate event location. The planned expansion includes the cultivation of a tourist information with office unit and gastronomy, whereby the northwestern cultivation is to be demolished. Even if the plaintiff cited a possible invalidity of the development plan, the court found that the fountain hall is in a factual mixed area, so that the applicant was excluded. In addition, according to the sound engineering report, the approved company does not cause any unreasonable noise pollution.

The judgment of June 29, 2023 allows the plaintiff to submit an application to the Rhineland-Palatinate Higher Administrative Court within one month of delivery.
