On November 28, 2024, the Koblenz administrative court ruled that the planning approval for the dismantling of the weir of the Dust (victory) was illegal for the time being and must not be carried out. The military system in Euteneuen has not been in operation since 2015. In December 2023, the Structure and Approval Directorate North granted approval for the dismantling and the redesign of the river bed into a natural asymmetrical rough manner. In the course of the approval process, a preliminary examination of the environmental impact assessment (RRP) was carried out, which, however, denied the need for a comprehensive RRP.
The result of this UVP preliminary examination was assessed as incomprehensible with regard to the species protection specialist contribution. It remains unclear whether special or strictly protected animal and plant species are affected. A determined procedural error led to the determination of the illegality of the approval. However, this is not lifted, since the error may be remedied by a plane supplement or a supplementary procedure. No other rüm -efficient procedural defects or material errors in the planning approval were not found. Participants have the option of submitting an application for admission to the appeal.

The planning of the structure and approval directorate north provides the demolition of the existing weir system in flowing wave. After the military dismantling, a design of the asymmetrical roughener is intended on the left side. The natural development of victory and the restoration of natural flow water structures are of great ecological importance. The planning also takes into account the regular flooding of the floodplain forest complex to ensure its preservation. The background is that the water right for the small hydropower plant has gone out on June 01, 2015, and the military system has been unable to function since May 2018, since the movable dipper locks can no longer be set up.
An application by the owner for re -commissioning was rejected on October 14, 2019 due to incomplete plan documents. Intensive consultations for revising the plan documents were preceded. A lawsuit before the administrative court was dismissed and the appeal application at the Higher Administrative Court of Koblenz was legally rejected. The military facility and the adjacent bank properties are owned by the State of Rhineland-Palatinate, while the Krafthaus with the turbine belongs to a private owner. The victory represents an important target types for the long-distance dance hiking fish salmon in the Rhine catchment area, which underlines the need to restore linear continuousness to fulfill the EU water framework guidelines.
