New Law for Cookie Use: What is now to be found on website operators!
The city of Wiesbaden plans to set up a new regulatory office, which, in addition to its classic tasks, will also be responsible for completing the new Telecommunications Data Protection Act (TDDDG). This law, which came into force on May 14, 2024, regulates access to end devices and implements the Eprivacy Directive of the European Union. Data protection in the digital space also experiences a fundamental reorganization.
like Antenne Mainz , the new regulatory office will in future take a central role in order to monitor compliance with data protection provisions. This includes in particular the regulations around cookies that are considered personal data. The TDDDG extends the cookie rule in all types of end equipment, including smart home devices.
changes by the TDDDG
According to the provisions of the TDDDG, all non -necessary cookies require explicit consent of the users. This is a significant change compared to the previous practice. The purpose of the cookies does not matter, which means that website operators have to know all cookies used in order to be able to act in accordance with the right. The regulations aim to strengthen the privacy of users and prevent abuse
In addition, Section 26 of the TDDDG was introduced, which deals with a central consent management. Companies are encouraged to deal with data protection-friendly alternatives and to avoid services whose cookie purposes are unclear. This is also supported by the General Data Protection Regulation (GDPR), which has guaranteed fundamental rights in dealing with personal data since its entry on May 25, 2018.
The role of the GDPR
The GDPR stipulates that personal data may only be processed with the consent of those affected or on the basis of a legal basis. This corresponds to Article 8 of the EU Fundamental Rights Charter, which focuses on the right to protect such data. Authorities and companies must accordingly adhere to the requirements of the GDPR and its national implementations, such as the Federal Data Protection Act (BDSG). Special regulations are particularly important in the security area.
The importance of data protection is becoming increasingly clear in today's digital world. With the establishment of the new regulatory office in Wiesbaden, another step is undertaken to ensure compliance with these important requirements and to promote the protection of citizens. The effective implementation of the TDDDG and the GDPR is therefore crucial to ensure a high degree of data protection and data security for the population.
