High reminders for short parkers: Who protects drivers in Groß-Gerau?

At the Groß-Gerauer station, a private parking lot ensures increasing resentment among drivers. The parking lot operator demands two euros for twelve hours of parking time. However, what appears as a proportionate fee develops into a financial burden for many users. Alissa Ott, who parked there to let a friend get out quickly, received a reminder of 185.10 euros. Similar fates also report Sigi Ebner and Andrea Donzella, whose relatives only stayed in the parking lot for a short time. Her experiences illustrate a comprehensive problem that apparently can not only be observed in Groß-Gerau, but at many locations.

The law firm of lawyer Jan Bröcker from Lower Saxony ships these reminder letters to false parkers and argues that they have disregarded the terms of use. It is important to know that false parking in private parking spaces is not subject to the road traffic regulations, but is regulated by the regulations of the parking lot operator. These regulations are often unclear or not sufficiently known, which leads to uncertainty and the high dunning amounts that are imposed on the drivers. Traffic lawyer Uwe Lenhart criticizes the 185 euros as inappropriate in comparison to the parking fees.

Problem of excessive reminder fees

The consumer advice center also warns that not every punishment is appropriate and emphasizes that in case of doubt a court must decide on it. This effect is often often observed near supermarkets. There, many retail chains use private companies to control their customer parking spaces. The criminal tickets issued are often not lawful, since the conditions are not clearly communicated. Private parking lot operators exhibit nodules and the prerequisites for punishment are often questionable - there must be an effective contract for parking.

Daniela Mainka, a kiosk seller opposite the parking lot, has also received numerous complaints from customers who were confronted with duty letters. The city administration of Groß-Gerau currently sees no reason to act and has so far not taken any specific measures. The resentment of the citizens is growing, and many affected people have already paid the amounts required for fear of even higher costs. Lenhart advises: "Do not respond to such reminders at first, that could result in a legal dispute."

legal framework conditions

The factual situation about such private parking spaces is complex. Parking spaces must be clearly marked with appropriate signs, and the permissible parking time can be determined by the operator himself. As a rule, there are contractual penalties for false parking with an amount of 15 to 40 euros, although excessive punishments are not justified and must remain appropriate. Accordingly, it is allowed for operators to carry out vehicles or secure with parking claws as long as this is announced in the signs.

In order to underpin the procedure for false parkers, it is also advisable to document the situation carefully. A BGH judgment says that vehicle owners are also liable when others park with their vehicle for unauthorized persons. False parkers can be held responsible by the parking lot owner if you disregard the rules.

With the large number of lawsuits against false parking, which have to endure forms in Groß-Gerau and many other cities, it can be seen that the topic of parking space management and the associated contractual conditions require a comprehensive review.
