Branddrama in Gießen: DLRG wins in the legal dispute after the club home fire!

The conflict about the DLRG club home in Gießen, which was severely damaged several years ago by a devastating fire, has now been going on for many years. As early as January 7, 2017, the incident occurred in which the "Aura" restaurant burned down to the foundations. It is controversial whether improper welding work on the roof was responsible for the fire. As giessener-zeiger.de reports, the DLRG is now planning legal steps against the former tenant of the restaurant, Dimitri Skartsanis, Request rental residues and compensation.

The fire led to the complete destruction of the building and to close the clubhouse. In the seven years since the accident, the legal disputes about the tenancy between the DLRG and Skartsis have intensified. However, a procedure for a possible complicity of the tenant was repeatedly made more difficult by the lack of crucial evidence. Among other things, an submitted expert opinion was rejected, and the metal builder, who repaired the trigger hood of the restaurant, not welded.

the court resolutions and their consequences

According to the latest information, the Gießen district court has declared the tenancy between the DLRG and Skartsanis to end. This is a turn that DLRG chairman Alexander Sack took note of with relief. Sack now sees the opportunity to find a new tenant for the gastronomy in the rebuilt clubhouse. Rumors say that Giorgios Svolos, operator of the Irodion restaurant, would be an option as the new tenant. Nevertheless, many questions about lease payments and reasons for termination are unclear.

The DLRG places Skartsanis a shared responsibility for the fire because he had commissioned a craftsman who had done presumably improper work. Despite these confessions, however, the civil chamber could not provide any clear evidence in order to clearly confirm the leaseholder's debt. In any case, the criminal investigation has already been discontinued.

The connection to fire protection issues

The case also raises basic questions about fire protection. According to the Institute for Damage Prevention and Damage Research , many fires arise from human misconduct and fire-hazardous work such as welding. In 2021, no clear cause could be found with every fifth fire. It remains to be seen which measures the DLRG will take to avoid future incidents of this kind and to ensure safe operation in the new clubhouse.

The negotiations between the DLRG and Skartsanis are expected to continue in July, and the DLRG has already started preparations for the reconstruction of the clubhouse. In total, investments of 3.25 million euros are planned for this, with the aim of completing the building by early 2021.

The complexity and three -dimensionality of this legal dispute not only reflect the challenges that bring such lengthy arguments with themselves, but also the importance of fire protection measures and the responsibility of operators in gastronomy and business.
